APPALACHIAN POR COMPANY,
a corporation.
In the matter of increesed
rates end charges.
WHEREAS, on the 27th day of April 1979, Appalachlan Power
Company, a corporetlon, tendered for filing revised tariff
sheets reflecting increased rates sad charges for furnishing
electric service in the State of West Virginia; and
WHEREAS, with its revised tariff sheets, Appalachian
Power Company has filed exhibits which are required by Rule 42
of the Rules and Requlatlons for the Cvernment of the
Construction end Filing .of Tariffs of Public Utilities and
Coon Carriers bY Motor Vehicle; a petition for immediate
rate relief requesting that the proposed increased rates and
charges become effective subject to refund on May 28, 1979,
or in the alternative, that any suspension period be limited
to no more than thirty-three (33) days .so that the proposed
rates will become effective subject to refund not later than
July 1, 1979, and further requesting that hearings on said
petition be scheduled at the earliest possible date; prepared
testimony in support of said petition; and a further petition
requesting the Commission to establish a separate proceeding
to consider the standards and concepts included in the Public
Utility Regulatory Policies Act of 1979 (PURPAi and Enrolled
Committee Substitute for H.B. 1,280 as such standards
and €oncepts relate to Appalachian's West Virqlnla operations
and further requesting that the Commission sohedule a prehearlng
• conference within sixty (60) days of April 27, 1979, so
that Appalachian, the Colssion's staff, and interested
parties may consider in detail the procedural and substantive
proceedinqt and
WHEREAS, on the 10th day Of May 1979, the City of Princeton,
Mercer County, tendered for filing a formal Protest of the City
of Princeton to the proposed rate Increase; and
IEREAS, on the 21st day of May 1979, the Coalition of
Appalachian Energy Consumers, Inc., by its West Virginia
constituent members, which joined as individual petitioners;
the Council of Senior West Virginiens; the West Virginia Citizens
Action Group; the Coalition on Legislation for the Elderly;
and United Mine Workers of America District |17 tendered for
filing a Joint Petition to Intervene in this proceeding and
further filed an Answer of Intervenora to Applicant's Petition
for Immediate Rate Relief, an Answer of Intervenors to Applicant's
Petition to Separate "H.B. 280" and "PURPA" Issues from Pending
Rate Case, and Residential Intervenors First Data Request; and
WIIEREAS, on the 24th day of May 1979, Huntington Alloys,
Inc., tendered for filing a Petition of Huntington Alloys, Inc.,
to Intervene in this proceeding.
IT IS, THEREFORE, ORDRRED that the aforesaid revised
tariff sheets be, and they hereby are, suspended and the use
of the rates and charges stated therein deferred for the maximum
statutory period of one hundred twenty (12O) days from May 28,
1979, until September 25, 1979.
IT IS FURTHER ORDERED that if this case has not been
finally decided at the expiration of the aforesaid suspension
period, such rates and charges as applied for shall not be
placed in effect until the respondent has entered into a bond
with surety approved, by the Commission (which approval shall
be given bY the Chairman of the Commission Indicating same
.thereon) in the amount of $61,169,000 conditioned for refund to
the persons or parties entitled thereto of the amount of excess,
if any, plus interest at a rate later to be determined by
the Commission, al required by Chapter 24, Article 2. Section 4
of the West Virginia Code, as amended, and filed said bond with
the Secretary of the Commission.
IT IS FURTHER ORDERED that Appalachian Power Company, a
corporation, be made.respondent to this proceeding and that
this matter berset for hearing to be held In the Commission's
Hearing Room at the Capitol in the City of Charleston on the
26th day of'June 1979, at 9:30 e.m., EDST, at which time and
place Appalachian Power Company shall appear and present its
direct testimony. The direct testimony shall include evidence
concerning certification of compliance with the wage and
price guidelines as established by the Council on Wage-Price
Stability on December 13, 1978.
IT IS FURTHER ORDERED that at said hearing anyone interested
may appear and provide testimony and recommendations as to the
procedure to be followed by this Commission in considering the
issues set forth in the Public Utility Regulatory Policies Act
of 1978 (PURPA) and Enrolled Committee Substitute for ll.B. 1280.
Leave is hereby granted to any person or corporation to file
its petition to intervene or protest at any time prior to or on
the date of said hearing.
IT IS FURTHER ORDERED that Appalachian Power Company,
a corporation, glee notice of the filing of the aforesaid tariff
changes and of the tlme and place of hearing thereon by posting
a copy of this order in a conspicuous place where bills for
electric service are paid for a period slat least fourteen (14)
days prior to the 26th day of June, 1979, for public inspection,
and by publishing a copy of this order twice in newspapers
published in each of the following Counties: Boone, Cabell,
Clay, Fayette, Greenbrler, Jackson, Hanawha, Lincoln, Logan,
Mason, McDowell, Mercer, MAngo, Monroe, Nicholas, Putnam,
Raleigh, Roast, Summers, Wayne and Wyomlnq. The first publlcatip
In each of the newspapers shall be made not less than fourteen
(14) deye prior to the 26th day of June 1979. The second
publication in each of the newspapers shall be made not less
than five (5) days prior to the 26th day of JUne 1979.
Appalachian Power Company, a corporation, shall make due return
of such publications on or before June 26, 1979.
IT IS FURTHER ORDERED that the Secretary of the Commission
be, and he hereby Is, directed to serve a copy of this order
upon Appalachian Power Company, a corporation, and upon anyone
having heretofore filed a Petition to Intervene in this
proceeding, by United States Certified Hail, return receipt
requested.
