IT IS, THEREFORE, ORDRRED that the aforesaid revised tariff sheets be, and they hereby are, suspended and the use of the rates and charges stated therein deferred for the maximum statutory period of one hundred twenty (12O) days from May 28, 1979, until September 25, 1979. IT IS FURTHER ORDERED that if this case has not been finally decided at the expiration of the aforesaid suspension period, such rates and charges as applied for shall not be placed in effect until the respondent has entered into a bond with surety approved, by the Commission (which approval shall be given bY the Chairman of the Commission Indicating same .thereon) in the amount of $61,169,000 conditioned for refund to the persons or parties entitled thereto of the amount of excess, if any, plus interest at a rate later to be determined by the Commission, al required by Chapter 24, Article 2. Section 4 of the West Virginia Code, as amended, and filed said bond with the Secretary of the Commission. IT IS FURTHER ORDERED that Appalachian Power Company, a corporation, be made.respondent to this proceeding and that this matter berset for hearing to be held In the Commission's Hearing Room at the Capitol in the City of Charleston on the 26th day of'June 1979, at 9:30 e.m., EDST, at which time and place Appalachian Power Company shall appear and present its direct testimony.
