Medicaid, the program that pays medicaid dollars. In 1991 the legis-
the medical bills of the poor and lature levied a tax on certain health
disabledhas a $70 million backlog of care providers, namely hospitals,
claims from doctors, hospitals, phar- doctors, dentists and others. These
macies and other providers. This providers have paid the tax in order
amount of monies needed to fully
fund the medicaid program. The
House took a different position. Their
program was cut by the administra-
tion. in the middle of the budget year,
which put a big dent in an already
underfunded program. Who pays for
this program? We the taxpayers pay
25 percent of the cost at the state
level and then we use this to match
75 percent of.the monies at the fed-
eral level which is also paid by us.
Without these federal monies, W.Va.
could in no way provide for its poor
and needy. The W.Va. Legislature
has no other choice than to draw
down federal dollars.
The ongoing battle in the legisla-
ture is who to tax to draw down the

to receive higher payments for see-
ing medicaid patients.
The federal government has said
this tax is flawed and must be
changed. They have said it must tax
all providers within a class and must
be broad based to include all provid-
ers.
As a result of the mandate from
the Federal Government, the legis-
lature has looked at taxing all health-
care providers gross income. The
battle that has insued revolved
around this issue. In Senate Bill No.
542 the Senate wanted to tax the
providers at a 2 percent of gross
income. According to the Tax and
Human Resouices Deptartments
this tax would not produce the
position was to tax all health care
providers at 1.25 percent of their
gross income, put a tax on tobacco
and I percent tax on people making
more than 100 thousand dollars.
Taxes raised under the House posi-
tion would raise enough monies to
fully fund the program.
On a split vote, the Senate on the
last day of the extended legislative
session voted to kill their own bill.
This is ironic, since we have spent so
much time working on a bill that
must be passed, only to have the
Senate tokillit. In reality, thismeans
we will have to come back to Char-
leston and deal with the Medicaid
issue again. Medicaid must be dealt
with in the very near future--this
means the legislature will be back in
session.
