Mrs. Farley is the volunteer services co- ordinator for the DNR Conservation Education and Litter Control Office; her office is located at MacArthur, WV. The West Virginia Adopt-A-High- way Program was developed to combat the terrible habit of litter- ing! W. Va. is a lovely state, and Summers County is one of the most scenic areas. M,C. Certificate No. P-5294. The request has been reviewed by the Commisaion's Utilities Division and, in a Memorand um duted March 7, 1990, and filed March 9, 1990, Senior Utilities Analyst Donald P. Cook, Motor Carrier Section, Utili- ties Division, reoommonded approval of the proposed inclusion of the additional rate for a helper in the Applicant's existing tariff. Mr. Cook stated the Com- mission Staffs review of other tariffs on file with the Commisaion revealed no other tariff with this specific teriffitom. However, Staffbetieves that the Applicant's request is four, noble, and will improve the safety of the public, when the hauler is required to tow largvr mobile homes. Mr. Cook intim atod that" larger mobile homes" meant those at least fourteen (14) feet in width. For this reason, Staff rcoommended approvul without hearing, following publication, if no protests were received. FINDINGS OP PACT I. Randall G. Dixon, doing business as Dixon's Shell Service, filed a r~quest to include an additions} hourly rateof$10.50 for a helper, when required, in its existing tariff. (See, Application filed February 22, 1990). 2. The reqm~t was reviewed by the Commission'c Utilitiee Divie]o~ and a Memorandum was prepared recommending approval of the inclusion of the oddi. lionel rate for a helper in the Applicant's existing tariff. (StaffMemorandum filed March 9, 1990). 3. Th e requested additional rate for a helper, in the amount of $102;0 per hour, when required, is rea~on- able and would improve the ~afety of the public when the Applicant is raquired to tow larger mobite hames,i.o., those at least fourteen (14') feet in width. (See, Staff Memorandum filed March 9, 1990). 4. West Virginia Cede 24A-5,2 provides the Public Service Commission with authority to modify notice requirementa regarding rate changes and to allow a rate change upon less than the notice Specified tn the Code. (See, West Virginia Cede 24A-5-2). CONCLUSION OF LAW Upoa oonsideration of all of the above, the Admin- istrative Law Judge 0kLJ) is of the opinion that the requested inclusion ofan additional rate. in the amount of $10.50 per hour, for a helper, when required, in the Applkant's ~,dsting tariff, as set forth in the applica- tion filed in this preceding on February 22, 1990, is reasonable and should he conditionally approved, but not strictly as recommended by the Commission's Staff. The ALJ is going to restrict the inclusion of the additional rate 0f$10.50 for a helper to include only those situations when such a helper is required in the Judgement of the Applicant, when the width of the mobile home is at least fourteen (14) feet,and upon full disclosure, in advance, to tho Applicant's customer that this additional rata will be charged. The ALJ is net going to require the Appli~mt to publish the epselfic rates and charges approved herein.
