ACTION: Proposed rule.
SUMMARY:
Technical information or comments are solicited on the
rOposed base (100-year) flood elevations listed below for selected
ations in Summers County, West Virginia.
,. These base (100-year) flood elevations are the basis for the flood
plain management measures that the community is required to
either adopt or show evidence of being already in effect in order to
qualify or remain qualified for participation in the National Flood
Insurance Program (NFIP).
DATES:
The period for comment will be ninety (90) days following the
second publication of this proposed rule in a newspaper of local
circulation in the above-named community.

SUPPLEMENTARY INFORMATION:

The Federal Insurance Administrator gives notice of the
proposed determinations of base (100-year) flood elevations for
Summers County; West Virignia in accordance with section 110 of
the Flood Disaster Protection Act of 1973 (Pub. L. 93- 234), 87 star.
980, which added the Housing and Urban Development Act of 1955
(Pub. L. 90-448)), 42 U.S.C. 4001-4128, and 24 CFR 1917.4 (a).
These elevations, together with the flood plain management
measures required by Section 1910.3 of the program regulations,
are the minimum that are required. They should not be construed
to mean the community must change any existing ordinances that
are more stringent in their flood plain management require-
ments. The community may at any time enact stricter
requirements on its own, or pursuant to policies established by
other Federal, State, or regional entities. These proposed
elevations will also be used to calculate the appropriate flood
insurance premium rates for new buildings and their contents and
for the second layer of insurance on existing buildings and their
contents.

COOL RIDGE- FLAT TOP PUBLIC SERVICE
DISTRICT, a public utility.
Application for a certificate of-
convenience and necessity to construct,
operate and maintain a public water
supply system in the Cool Ridge- Fiat
Top- Ghent areas of Raleigh County,
and including small areas of Mercer and
Summers Counties.
WHEREAS, on March 6, 1979, the Cool Ridge- Flat Top Public
Service District, a public utility, filed an application, duly
verified, for a certificate of convenience and necessity to
construct, operate and maintain a public water supply system in
the Cool Ridge- Flat Top- Ghent areas of Raleigh County, and
including small areas of Mercer and Summers Counties, and for
approval of the following rates and charges:
PROPOSED RATES
Availability of Service
Available for general domestic, commercial, and industrial
service. Applicable in entire territory served.
Rates
First 3,000 gallons used per month $4.00 per thousand gallons
Next 3,000 gallons used per month $3.50 per thousand galions
Next 4,000 gallons used per month $3.05 per thousand gallons
Next 10,000 gallons used pet" month $2.50 per thousand gallons
All over 20,000 gallons used per month $2.05 per thousand gallons
Flat Rate
Installations which are serviced without a meter shall be
charged a flat rate equal to the minimum charge per month for
the size meter which would be required.
Minimum Charge
No bill will be rendered for less than the following amounts,
according to the size of the meter installed, to wit:

I- inch meter
I - /z -inch meter
2-inch meter
3-inch meter
4-inch meter
6-inch meter
$12.05 per month

Delayed Payment Penalty
The above tariff is net, on all accounts not paid in full within
twenty (20) days of date of bill, ten percent (I0 percent) will be
added to net amount shown.
If any bill is not paid within sixty (60) days after date, water
service to the customer will be discontinued. Water service will
not be restored until all past due water bills have been paid in full
and all accrued penalties plus a reconnection charge have been
paid.
Reconnection Charge
$10.0o ( Ten Dollars).
Connection Charge
Prior to award of construction contract, there shall be a charge
for connection to the system of $30.05 (Fifty Dollars).
Subsequent to award to construction contract, there shall be a
charge for a % inch meter connection to the system of one
hundred fifty dollars ($150.00). Meters % inches and larger shall
be connected at the actual cost of installation, including materials
and labor.
Multiple Occupancy
On apartment buildings, or other multiple occupancy buildings,
bills will be rendered based on each family or business unit
located therein paying hot less than the minimum monthly charge
herein established for a % inch meter, the minimum bill for the
size of meter installed, or the actual charge for water used,
whichever is greater. Motels and hotels shall pay according to the
size meter installed.
Trailer Courts
• House trailer courts shall be provided with a master meter. No
bill shall be rendered for less than the minimum bill herein
established for a % inch meter, multiplied by the number of units
situated on the court site at the time the meter is read, the
minimum bill for the size of meter installed, or the actual charge
for water used, whichever is greater. House trailers ( as used
herein-above) shall include both mobile and immobile units.

any other family or business unit.
IT IS ORDERED that this matter be set for hearing to be held in
the Commission's Hearing Room at the Capitol in the City of
Charleston on the 3rd day of May, 1979, at 9:30 a.m., EDST, at
which time and place the applicant may appear and prosecute
said application• Leave is hereby granted to anyone interested to
file objection to said application at any time on or before said date
or at said hearing.
IT IS FURTHER ORDERED that the applicant give notice of
the filing of said application and of the time and place Of hearing
by publishing a copy of this order in a newspaper published and of
general circulation in each of the Counties of Raleigh, Mercer and
Summers, once a week for two (2) successive weeks, the first
publication to be made not more than thirty (30) days nor less

COOL RIDGE- FLAT TOP PUBLIC SERVICE
DISTRICT, a public utility.
Application for a certificate of-
convenience and necessity to construct,
operate and maintain a public water
supply system in the Cool Ridge- Fiat
Top- Ghent areas of Raleigh County,
and including small areas of Mercer and
Summers Counties.
WHEREAS, on March 6, 1979, the Cool Ridge- Flat Top Public
Service District, a public utility, filed an application, duly
verified, for a certificate of convenience and necessity to
construct, operate and maintain a public water supply system in
the Cool Ridge- Flat Top- Ghent areas of Raleigh County, and
including small areas of Mercer and Summers Counties, and for
approval of the following rates and charges:
PROPOSED RATES
Availability of Service
Available for general domestic, commercial, and industrial
service. Applicable in entire territory served.
Rates
First 3,000 gallons used per month $4.00 per thousand gallons
Next 3,000 gallons used per month $3.50 per thousand galions
Next 4,000 gallons used per month $3.05 per thousand gallons
Next 10,000 gallons used pet" month $2.50 per thousand gallons
All over 20,000 gallons used per month $2.05 per thousand gallons
Flat Rate
Installations which are serviced without a meter shall be
charged a flat rate equal to the minimum charge per month for
the size meter which would be required.
Minimum Charge
No bill will be rendered for less than the following amounts,
according to the size of the meter installed, to wit:

I- inch meter
I - /z -inch meter
2-inch meter
3-inch meter
4-inch meter
6-inch meter

Delayed Payment Penalty
The above tariff is net, on all accounts not paid in full within
twenty (20) days of date of bill, ten percent (I0 percent) will be
added to net amount shown.
If any bill is not paid within sixty (60) days after date, water
service to the customer will be discontinued. Water service will
not be restored until all past due water bills have been paid in full
and all accrued penalties plus a reconnection charge have been
paid.
Reconnection Charge
$10.0o ( Ten Dollars).
Connection Charge
Prior to award of construction contract, there shall be a charge
for connection to the system of $30.05 (Fifty Dollars).
Subsequent to award to construction contract, there shall be a
charge for a % inch meter connection to the system of one
hundred fifty dollars ($150.00). Meters % inches and larger shall
be connected at the actual cost of installation, including materials
and labor.
Multiple Occupancy
On apartment buildings, or other multiple occupancy buildings,
bills will be rendered based on each family or business unit
located therein paying hot less than the minimum monthly charge
herein established for a % inch meter, the minimum bill for the
size of meter installed, or the actual charge for water used,
whichever is greater. Motels and hotels shall pay according to the
size meter installed.
Trailer Courts
• House trailer courts shall be provided with a master meter. No
bill shall be rendered for less than the minimum bill herein
established for a % inch meter, multiplied by the number of units
situated on the court site at the time the meter is read, the
minimum bill for the size of meter installed, or the actual charge
for water used, whichever is greater. House trailers ( as used
herein-above) shall include both mobile and immobile units.

any other family or business unit.
IT IS ORDERED that this matter be set for hearing to be held in
the Commission's Hearing Room at the Capitol in the City of
Charleston on the 3rd day of May, 1979, at 9:30 a.m., EDST, at
which time and place the applicant may appear and prosecute
said application• Leave is hereby granted to anyone interested to
file objection to said application at any time on or before said date
or at said hearing.
IT IS FURTHER ORDERED that the applicant give notice of
the filing of said application and of the time and place Of hearing
by publishing a copy of this order in a newspaper published and of
general circulation in each of the Counties of Raleigh, Mercer and
Summers, once a week for two (2) successive weeks, the first
publication to be made not more than thirty (30) days nor less
than fifteen (15) days prior to the 'd day of May, 1979, making
due return thereof on or before the day of hearing.

gnosed, that the illness could

that the prescribed treatment
will help the condition and the
benefits outweigh the disadv-
antages and cost of the reg-
imen.
