At a session ofthe Public Service Commission of
West Virginia in the City of Charleston on the 1" day
of Decemberr 2015.
The Commission (i) sets a procedural schedule, (it)
grants a petition to intervene for SWVA, Inc., (iii)
grants a motion for admission "pro hac vice," and (iv)
requires publication of the hearing.
BACKGROUND
On October 8, 2015, Appalachian Power Company
(APCo) and Wheeling Power Company (WPCo), both
dba American Electric Power (collectively Companies)
filed an application for revisions to the Terms and
Conditions of Service (Original Tariff Sheet Nes.3-1
to 3-12 of the Tariffs for each of the Companies) and
their Underground Service Plan (Original Sheet Nos
3-13 to 3-24 of the tariffs for each of the Companies)
and for Commission consent and approval of other
related changes to the Companies' service.
The Companies filed the proposed tariff changes
with an effective date of November 7, 2015.
The proposed tariff changes affect term and
conditions of sarvice including security deposit terms
applicable to nonresidential customers, eliminating
the checklass payment plan, phasing out the equal
payment plan, adding provisions respecting a
customer's respensibihty for costs of the preparation
of engineering studies and estimates and relocation
of facilities, changes to customer's liability regarding
internal or external adjustment of meters, use of
energy by customers, denial or discontinuance of
service when utilities bills are owed to the Companies
or their affiliates in other states, increasing
reconnection charges, adding a customer investigation
charge, increasing bad check fee, credit card payments,
changing residential extensions of service terms, use
of customer data, changing underground service plan
terms, and
eliminating the special reconnection option.
On October 30, 2015, the Commission issued an
Order that (i) made the Companies Respondents to
these proceedings, (it) suspended the proposed tariff
until 12:01 a.m., on August 4,2016, (iii) granted a
request to intervene from the West Virginia Energy
Users Group (WVEUG), and (iv) addressed certain
motions of the parties pertaining to notice The
Consumer AdvoLate
Division (CAD) was granted intervenor status on
November 5, 2015.
The Companies and Staff proposed different
procedural schedules, but both parties were able to
agree on November 13, 2015, as the deadline for direct
testimony for the Companies. WVEUG did not oppose
this deadline and CAD did not comment on the
deadline. By Order entered November 10, 2015, the
Commission ordered the direct testimony of the
Companies to be filed on November 13,2015.
On November 9, 2015, SWVA, Inc. ISWVA) filed a
Petition to Intervene and a Motion for Pro Hac Vice
Admission of Damon E. Xenopoules. SWVA owns a
steel production facility located in Huntington, West
Virginia and utilizes an electric arc furnace to melt
