DAVID GILBERT IS RUNNING FOR PROSECUTING ATTORNEY
David Gilbert of Nimitz is running for Summers County Prosecuting Attorney. He is
married to Heather (Day) Gilbert..They have three children. Heather was raised in
Nimitz, and she is an author. Her parents are Stanley and Betty Day.
David grew up on a dairy farm in rural Western New York. He met Heather when they
were students at Bob Jones University. They married while he was a law student at
Columbia University. David graduated with a 4.0 from Bob Jones University. He was a
Stone Scholar at Columbia, and he served as a managing editor of the Columbia
Journal of Law and Social Problems. He also served as president of the Columbia
Coalition for Life.
After law school, David worked in the. New York City office of Kaye Scholer, LLP. He
was a corporate lawyer.
But both David and Heather felt the pull of the country, and in 2000 they moved to
Western New York. There David worked in a general practice firm. The biggest share
of his practice was advising towns, villages, and schools. David also served as an
assistant district attorney. As an ADA, he prosecuted felonies, misdemeanors, and
lesser offenses. On weekends, he helped out on his parents' farm.
In 2006, David was hired to teach at Liberty University School of Law in Lynchburg,
Virginia. At Liberty, David taught Criminal Law, Criminal Procedure, Environmental
Law, Legal H!story, and State and Local Government. He also coached negotiation
competition teams.
But family has always been important to David and Heather. In 2012, they moved to
Nimitz to be near Heather's family. David was hired to clerk for Circuit Judge Paul M.
Blake, Jr., of Fayetteville. In 2013, David formed a law practice in Beckley with two of
his former students, Todd Kirby and Lindsey Ashley. David's practice includes criminal
law, civil litigation, estate planning, and real estate.

Delegates. As legislative counsel, he advised the Education Committtee, the Political
Subdivisions Committee, and the Small Business, Entrepreneurship, and Economic
Development Committee.
David's work for the Legislature brought him into regular contact with Roy Cooper.
Roy encouraged David to run for Prosecuting Attorney.
David believes that the prosecuting attorney plays a key role in our criminal justice
system. The prosecutor, alone, is responsible for seeing that justice is done. David
believes that it is past time to hold criminals accountable and that the best way to do
