(1) That the grantees, their heirs and assigns, will not operate any mercantile business on the lot herein conveyed, without first obtaining the written consent of the grantors. (2) The plans for any house constructed on the lot herein conveyed, must be approved by at least two of the three male grantors herein. (3) Any and all toilets installed in property constructed on the lot herein conveyed, must be connected to a septic tank or its equivalent. (4) No septic tank or wells will be permitted to be installed on the lot herein conveyed, or any portion thereof, within sixty feet of Leisure Lake, except with the approval of two of the three male grantors herein. (5) No hog pens, cow pens, chicken houses or things of like nature, shall be permitted to be installed on the property herein conveyed. Mildred Lilly died intestate on March 12, 2014. Pursuant to W. Va. Code § 42-1-3a, David Kent Lilly and Lowie E. Lilly, the parties to the partition action, are her sole heirs-at-law and therefore each acquired a one-half undivided interest in said real estate as result of her death. Pursuant to all of the above, foregoing real estate owned by Mildred Lilly at the time of her death is now owned by the following individuals in the fractional interests set forth: David Kent Lilly 1/2 interest, Lowie E.
