PLEASE TAKE NOTICE that by virtue of an
Order of the Circuit Court of Summers County, West
Virginia entered on December 14. 2015, by Judge
Robert A. Irons, in that certain civil action styled,
Lowie E. Lilly v David Kent Lilly, Civil Action No. 1 5-
C-790 and pursuant to the authority vested in them
by said order, Thoma H.-Ewing and Jason Grubb,
the undersigned Special Commissioners, will on
MONDAY, MARCH 14, 2016, at 3:00 pm. sell to the
highest bidder at Public Auction at the front steps of
the Summers County Courthouse, Hinton, West
Virginia, the following tracts or parcels real estate,
situate in Green Sulphur District of Summers County,
West Virginia. with the improvements thereon and
appurtenances thereunto belonging. bounded and

Lot No. 38 adioining Lot No. 36, as shown by a map of
the Rushford-Webb-Rushford Subdivision. as surveyed
by DeRamino and Egan, on April 16, 1966, a copy of
which map is filed with a dead from the Bryant
Rushford, et al., Cora Gene Dobbins, dated August 3,
1968, and of record in the Office of the Clerk of the
County Court of Summers County, West Virginia, in
Dead Book No. 103. page 429. Both properties
combined front 75 feet and extend back between
parallel lines to New River.
AND BEING a part of the same property conveyed
to the male grantors herein by deed dated November
27, 1964. from the Summers County Industrial
Corporation, of record in the said Clerk's Office in Deed

There is a tile passing through lot No. 36, which
is hereby specifically reserved, and the right to
maintain the same.
Being the same tract or parcel conveyed to Freddie
L. Lilly and Mildred Lilly, his wife. being the same
person as Mildred Lilly, “for and during the term of
their natural lives, with the reminder to the survivor
of them,” by deed dated March 6. 1969, from Bryant
Rushford et al, of record in the Office of the Clerk of
the County Commission of Summers County, West
Virginia (“Clerk's Office") in Deed Book 104, at page
112. Freddie L. Lilly predeceased Mildred Lilly. thereby
vesting full title to said real estate in Mildred Lilly
pursuant to the terms of said deed.
The real estate is referred to in the land books of
Summers County as Lot 36 and In of 38 R W Rushford
Sub Division. District 3 (Green Sulphur). Tax Map 36,
Parcel 36.

Being the same tract or parcel conveyed to Mildred
G. Lilly, being the some person as Mildred Lilly, by
deed dated July 14, 1975, from Bryant Rushford, et
al., of record in the Clerk's Office in Deed Book 122, at
page 92.
The real estate is referred to in the land books of
Summers County is Lot 35 Rushford Sub Division,
District 3 (Green Sulphur) Map 36, Parcel 35.

BEING Lot No. 37 and the northerly one-half of
Lot No. 39, as shown by a map of the Rushford-Webb-
Rushford Subdivision, as surveyed by DeRamino and
Egan,April 16, 1966, a copy of which map I filed with
a deed from Bryant Rushford, et al, to Cora Gene
Dobbins, dated August 3, 1968, and of record in the
Office of the Clerk of the County Court of Summers
County, West Virginia, in Deed Book No. 103, page
429.
Being the same tract or parcel conveyed to Freddie
L. Lilly and Mildred Lilly, his wife, being the same
person as Mildred Lilly, “for and during the term of
their natural lives, with the remainder to the survivor
of them," by deed dated May 1, 1973, from Bryant
Rushford et al, of record in the Clerk’s Office in Deed
Book 114, at page 246. Freddie Lilly predeceased
Mildred Lilly, thereby vesting full title to said real
estate in Mildred Lilly pursuant to the terms of said
deed.
The real estate is referred to in the land books of
Summers County as Lot 37 and Northerly 1/2 Lot 39,
Barksdale, District 3 (Green Sulphur), Map 36, Parcel
37 and 39.
The degds in chain of title to the foregoing parcels
of real estate alsoir’r‘chide the lbiiowin'g grant: the right '
to use all streets and pedestrian lanes as lpid‘ out on
the map of said property, together with the right ‘to'
use boat docks in the river, but this right shall be used
in conjunction with the owners of all other lots in the
sub-division.
The deeds in the chain of title to the foregoing
parcels of real estate include and are subject to the
following reservations:
(1) leisure Lake and the passwsy or border area
around the lake is retained by the grantors.
(2) There is reserved from the operation of prior
conveyances the right to lay drains from the lake,
including pipe lines.
(3) There is also reserved the right to lay sewer
drainage pipes, and the right to install a water supply
system, and to pipe the same to the various lots.
The deeds in the chain of title to the foregoing
parcels of real estate include and are subject to the
following restrictions.
(1) That the grantees, their heirs and assigns, will
not operate any mercantile business on the lot herein
conveyed, without first obtaining the written consent
of the grantors.
(2) The plans for any house constructed on the lot
herein conveyed, must be approved by at least two of
the three male grantors herein.
(3) Any and all toilets installed in property
constructed on the lot herein conveyed, must be
connected to a septic tank or its equivalent.
(4) No septic tank or wells will be permitted to be
installed on the lot herein conveyed, or any portion
thereof, within sixty feet of Leisure Lake, except with
the approval of two of the three male grantors herein.
(5) No hog pens, cow pens, chicken houses or things
of like nature, shall be permitted to be installed on
the property herein conveyed.
Tho deeds in the chain of title to the foregoing
parcels are subject to the following further condition
or covenant:
Should the grantees, their heirs and assigns,
violate any of the restrictive covenants as herein Set
forth, then and in that event the grantors as herein,
shall have the right to apply to the Circuit Court of
Summers County, West Virginia, for an injunction
enjoining the further violation of any of these
restrictive ovenants, and this shall be a covenant
running with the land.
Mildred Lilly died intestate on March 12, 2014.
Pursuant to W. Va. Code § 42-1-3a, David Kent Lilly
and Lowie E. Lilly, the parties to the partition action,
are her sole heirs-at-law and therefore each acquired
a one-half undivided interest in said real estate as
result of her death.
Pursuant to all of the above, foregoing real estate
owned by Mildred Lilly at the time of her death is now
owned by the following individuals in the fractional
interests set forth: David Kent Lilly 1/2 interest, Lowie
E. Lilly 1/2 interest.
TERMS OF SALE: Cash in hand on day of sale.
The subject property and any improvements thereon
are being sold AS-IS, WHERE-IS, WITHOUT
REPRESENTATION OR WARRANTY OF NAY KIN D,
EXPRESS OR IMPLIED, AS TO THEIR CONDITION
OR. FITNESS FORANY PURPOSE ORAS TO THEIR
COMPLIANCE, WITH ANY LAWS.
This sale is being made subject to all restrictions,
Conditions, reservations and easements contained in
deeds or instruments of record in aforesaid Clerk’s

Assessment Bluestone Lake water control Manual
Initial Deviation Bluestone Dam, Summers County
The US. Army Corps of Engineers, Huntington
District, by this Notice of Availability (NOA), advises
the public that the Draft Environmental Assessment
(DEA) for the Bluestone Lake Water Control Manual
Initial Deviation is complete and available for public
review. Bluestone Dam is located on the New River in
Summers County, West Virginia. A Finding of No
Significant Impact (FONSI) is anticipated for the
proposed action. A Draft FONSI is included with the
DEA for public review.
In compliance with the National Environmental
Policy Act (NEPA) and 40 CFR 1501.4, the DEA and
drafi. FONSI must be available to the public in the
affected area for thirty (30) days for review and
comment. Final determination regarding the need for
additional NEPA documentation will be made after
the public review period, which begins on or about

Ordinance. The proceeds of the Series 2016 Bonds will
be used: (i) to pay a portion of the costs of acquisition
and construction of certain extensions, additions
betterments and improvements to the existing public
sewerage system of the Issuer (the “Project"); and (ii)
to pay revenues to be derived from the ownership and
operation of the 'lbwn. No taxes may at any tim time
be levied for the payment of the Series 2016 Bonds or
the interest thereon.
A certified copy of the above—entitled Ordiance is
on file with the Council at the office of the Recorder
for review by interested parties during regular office

The Hinton Lions Club is asking
for the Communities support in
helping to provide those who need,
eye examinations or eye glasses.
The Hinton Lions have been
providing assistance for over 18
years and are asking community
organizations and businesses as well
as citizens for monetary donations
to continue providing help to those
in need in our community. As news
spreads of the help being provided,
requests are now outnumbering the
Lions Club’s ability to help.
Once a request is received, the
individual’s application is screened
to insure that other avenues of
assistance are pursued before the
Lions Club provides help.
