NOTICE OF PARTITION SALE
AT PUBLIC AUCTION
PURSUANT TO W. VA. CODE] 37-4-3
PLEASE TAKE NOTICE that by virtue of an
Order of the Circuit Court of Summers County, West
Virginia entered on December 14, 2016, by Judge
Robert A. Irons, in that certain civil action styled,
Lowie E. Lilly v David Kent Lilly, Civil Action No. 1 5-
C-730 and pursuant to the authority vested in them
by said order, Thomas H. Ewing and Jason Grubb,
the undersigned Special Commissioners, will on
MONDAY, MARCH 14, 2016, at 3:00 p.m. sail to the
highest bidder at Public Auction at the front steps of
the Summers County Courthouse, Hinton, West
Virginia, the follow~g tracts or parcels real estate,
situate in Green Sulphur District of Summers County,
West Virginia, with the improvements thereon and
appurtenances thereunto belonging, bounded and
described as follows:
Parcel 1:
BEING Lot No' 36 and the northerly one-half of
Lot No. 38 adjoining LOt No. 36, as shown by a map of
the Rush ford-Webb-Ru sh ford Subdivision, as surveyed
by DeRamino and Egan, on April 16, 1966, a copy of
which map is filed with a deed from the Bryant
Ruehford, at aL, Gora Gone Dobbins, dated August 3,
1968, and of record in the Office of the Clerk of the
County Court of Summers County, West Virginia, in
Deed Book No. 103, page 429..Both properties
combined front 7,5 feet end extend back between
parallel lines to Now River.
AND BEING a part of the same property conveyed
to the male grantors herein by deed dated November
27, 1964, from the Summers County Industrial
Corporation, ofrscord in the said Clerk's Office in Deed
Book No. I00, page 466.
There is a tile passing through LOt No. 36, which
is hereby epecifically reserved, and the right to
maintain the same.
Being the same tract or parcel conveyed to Freddie
L. Lilly and Mildred Lilly, his wife, being the same
person as Mildred Lilly, "for and during the term of
their natural lives, with the remainder to the survivor
of them," by deed dated March 6, 1969, from Bryant
Rnshford etal, of cecerd in the Office of the Clerk of
the County Commission of Summers County, West
Virginia ("Clerk's Office") in Deed Book 104, at page
112. Freddie L. Lilly predeceased Mildred Lilly, thereby
vesting full title to said real estate in Mildred Lilly
pursuant to the terms of said deed.
The real estate is referred to in the land books of
Summers County as Lot 36 and :/2 of 38 R W Rushford
Sub Division, District 3 (Green Sulphur), Tax Map 36,
Parcel 36.
Parcel 2:
BEING Lot No. 36 of the Rash ford-Webb-Rnshford
Sdbdlviaion, as surveyed by DeBemino and Egan,April
16, 1966, a copy of which map is filed with a deed from
Bryant Rushford, et al., to Gora Gane Dobbins, dated
August 3, 1968, and of record in the Office of the Clerk
of the County Court of Summers County, West
Virginia, in Deed Book No. 103, page 429.
Being the same tract or parcel conveyed to Mildred
G. Lilly, being the same parson as Mildred Lilly, by
deed dated July 14, 1975, from Bryant Rushford, et
al., of record in the Clerk's Office in Deed Book 122, at
page 92.

District 3 (Green Sulphur) Map 36, Parcel 35.

BEING LOt No. 37 and the northerly one-half of
LOt No. 39, as shown by a map of the Rushford-Webb-
Rnshfecd Subdivision, as surveyed by DeRamino and
Egan, April 16, 1966, a copy of which map I filed with
a deed from Bryant Rushford, et al, to Gora Gene
Dobbins, dated August 3, 1968, and of record in the
Office of the Clerk of the County Court of Summers
