Jan. 9th indictment with a string of complaints in Magistrate Court against Lobban and otber court offid L On Jan. 18th Crawford filed charg against County Premcutor Joe Aucremanne, Circuit Judges FrankJolliffee andCharlseLobban, Magistrate Jamee Beasley, Sheriff's l~puty Jerry Smith, State Trooper M. R. Miller, City officer B. B. Angell and Police Chief John Plumley. In his complaint, Crawford al- leges that the indictment was an "assault" against him and that the officers "breached the divison of powers" placing him, due to the indictment, *in a~mlute fear of my rights to liberty and freedom." The complaint was filed before Magistrate Bill Jeffries who refused to issue any warrants saying, based on the complaint, there was =no probable causem or "any criminal violation of state lawY Crawford followed this in Circuit Court with a "Writ of Prohabition," on Jan. 19, claiming that hie Grand Jury *indictment is unconstitu- tional." On Jan. 23 he went before Jef- fries again and filed another com- plaint against Lobban and Aucre- manne alleging "attempted extor- tion by threats." Jeffries found'no probable cauee~ and did not issue warrants. The following day Crawford filed a "Writ of Mandamus" asking the Circuit Judge to "compel" Magis- trate Jeffriee "to issue warrants Magistrate Clerk Kay Steele, Dep- uty Jerry Smith, Judge Lobban, Ricky Brown, Reva Brown and Frances Brown. False swearing charges were also filed against Reva and Frances Brown. Charges alleging that Trooper Miller and Angell assisted in the escape of a prisoner and that Smith, Angell and Beasley allegedly failed to report a violation of the law were also filed. Two criminal felony complaints were filed against Lobban and three criminal felony complaints against Aucremanne claiming that they have failed to perform their official duties along with other criminal felony complaints claiming that Lobban and Aucremanne allegedly attempted to impede the testimony of a witness before the Grand Jury. All the complaints were before Jeffries and all the complaints were thrown out, Jeffries ruling that there was "no probable cause" for issuing warrants based on the complaint. Although Crawford did not ask for a special judge to be appointed to his case, Lobban contacted the Supreme Court of Appeals and in- formed them that he "has been named as a defendant" in com- plaints filed in Magistrate Court and asked if he "should be disquali- fied from presiding in any" court matters involving Crawford, Neely states in his order. A date for the disqualification Crawford abused the judicial sys- tem by =making the process~ of swearing out warrants against citi- zens ~the punishment~ and then "withdrawing the warrants....only after the individual had been ar- rested, arraigned, fingerprinted, and required to post bond." The petition includes five warrants is- sued between May andAugust, 1989 that, the petition says, were with- drawn. According to the petition, Crawford filed charges against Reva Brown in Sept. 1988 claiming that she =threatened to shoot two chil- dren." Aucremanne investigated the complaint and "chose not to prosecute." The matter was brought to Lobban's attention and he de- clined to order Aucremanne to prosecute. "As a result of the court's action, Mr. Crawford filed a crimi- nal complaint against Judge Lobban on Jan. 29, 1990" claiming that Lobban failed to perform his official duties. He also tried to get war- rants against Lobban and Aucre- manne =charging extortion by threats~ because of Lobban's refusal to order Aucremanne to prosecute Reva Brown, according to the peti- tion. In another complaint, Crawford's wife, Sidika, filed charges against Frances ~ixie~ Brown, claiming that Brown attacked her. Follow- ing a jury trial before a special magistrate, Edward Hicks of Green- brier Co., Brown was found .guilty and sentenced to 6 months. Having failed he filed false swearing charges against Reva and Frances Brown in magistrate court and tried to get criminal warrants issued againt Lobban, according to the petition. "Moreover, Roger Crawford has maliciously filed numerous com- plaints with unsubstantiated and frivilous allegation against several judicial and public figures....,~ the Peti~on states. =The purpose of such complaints was to deliberately terrorize individuals within the legal system in their performance of their public duties." The petition argues that under the present Rules of Criminal Pro- cedure "the magistrate is limited to looking at the four corners" of the complaint and that West Virginia is "one of the few remaining states" where a person can file a complaint against another "without an inves- tigation by a police officer." According to the petition, =an investigation into Mr. Crawford's past conduct in relationship to magistrate court will show a clear, calculated and malicious abuse of the judicial process .... in seeking criminal warrants in an attempt to nullify the authority of the judicial system....(and) would ask that thet circuit judges and prosecutors r,~n cube themselves on the grounds of bias since he had brought com- plaints against them."
