in the Summers County CourthouN, 120 Ballengee

County Building Commission (the "Building

Commission shall be put into effect.

2003, the Building Commission enacted an Ordinance
ordering the issuance of not more than $1,200,000
Summers County Building Commission Lease
Revenue Bonds (Summers County Judicial Annex
Project) in one or mere series (the trends'9 to finance
the of cemplatng the improvement and equipping
of the real estate, together with the improvements
thereon, located at 123 Temple Street, Hinten, West
Vh'ginia, to provide a new Judicial Annex for Summers
County, Wsat Virginia and the inhabitants themof(tha
"Project ) and to refund the Building Commission's
Lease Revenue Bends (Summers County Courthouse
Judicial Annex Project) Series 2002 currently
outstanding in the approximate amount of $485,000
(the "Prior Bends') The Ordinance further provides
for the leasing of the Project to The County
Commission of Summers County, West Virginia (the
"Lease").
The Bonds will be special obligations of the
Building Commission payable solely from the •
revenues, rentals, and other monies reived by the
Building Commission pursuant to the Lease and any
other permitted lease of the Project and other security
held pursuant to a bond purehasa agreement deeribed
below and will not constitute a debt or liability of
Summers County, Wsat Virginia (except as provided
in the Lease) or the State of Wcet Vh'ginia.
The Ordinance further provides for a bond
purchase agreement to be entered into among the
Building Commission, The County Commission of
Summers County, West Virginia and the original
purchaser of the Bonds by which the Building
Commission will assign to the original purchaser of
the Bonds, the right to receive rental and other
payments under the Lease or other leases permitted
by the bend purchase agreement or deed of trust on
the Project to further secure the owner of the Bends
and the Building Commission will deliver the Bonds
in return for the purchase price thereof to be used to
pay the costs of the Project and to refund the Prior
Bonds. Accordingly, the Project will be leased by the
Building Commission to The County Commission of
Summers County, West Virginia pursuant to the Lease.

proposed forms of the Lease and related documents,
is on file for review by interested parsons during
