Johnson, who is one ,and the same as Charles A. Johnson, by deed dated July 25, 1939, from Harold E. Price as Clerk of the County Court of Summers County, West Virginia, in Deed Book 70 at page 412. It appearing by affidavit filed in this action that said BENNY HERNDON: CHARLES JOHNSON & DORIS JOHNSON; RUBY MOYER & MICKEY MOYER, ROSIE HAIRSTON & -HAIR--N, and William Jo~, Jr., are nonresidents of the State of West Virginia; that there are or may be pesons other than those named above as plantiff and defendants who are heirs of said CHARLES A.
